Terms & Conditions

This document sets out the full Terms  & Conditions governing all bookings and stays at Riva  One. It incorporates, in full,  the annexures for Parking & Access  Gate Terms,  E-Bike Use and Indemnity, and the Drone Policy.  By making a booking, confirming a reservation, checking in, or remaining on the property, the Guest agrees to be bound by this document.

Parties to the Agreement

Riva  One  (“Riva One”)  is a luxury hospitality brand  operated  and managed  by  Alfa  One  Estates

(Pty)  Ltd (“Alfa  One Estates”, “we”, “us”), a company registered in the Republic of South Africa.

 

The accommodation agreement is concluded directly between the Guest and Alfa  One Estates (Pty) Ltd.

All references to “Riva  One”  in this document include Alfa  One  Estates  (Pty)  Ltd,  its directors, employees, agents, and contractors.

  1. Rates & Payment Terms

1.1 Rates are quoted per accommodation unit (suite/room/villa, as applicable) and include standard cleaning services (unless otherwise specified on your booking platform),  access to communal areas, any applicable government taxes, and 15% VAT. All rates are in South African Rand (ZAR).

1.2 Additional services (for example: extra cleaning,  laundry services, special requests,  late check-out)  may incur extra charges and must be arranged either  prior to arrival or during your stay, subject to availability.

1.3 To secure and confirm your booking, the following deposit schedule  applies:

  • 50% deposit required at the time of booking.
  • The deposit will be applied toward any applicable cancellation fee as outlined in the Cancellation Policy (Section 2).

1.4 Payment deadlines:

  • Villa bookings:  the remaining balance (including extras)  is due no later than 30 days prior to arrival (depending on season), or in full upon booking if the reservation is made within 30 days of arrival.
  • Guesthouses & apartments: the remaining balance (including extras)  is due no later than 14 days prior to arrival (depending on season), or in full upon booking if the reservation is made within 14 days of arrival.

1.5 The exact payment deadline will be specified in your booking confirmation. Payments may be made via secure payment link,  credit/debit card, or bank transfer.

1.6 Bookings are confirmed only upon receipt of the required deposit,  all necessary guest details, and written confirmation from Alfa One Estates.

1.7 Unconfirmed bookings may be cancelled without notice.

 

  1. Cancellation & Refunds

2.1 Cancellation fees apply on the full value of the booking: Villa  bookings

  • More than 30 days prior to arrival: refund of deposit amount paid.
  • Less than 30 days prior to arrival, including no-shows: 100% cancellation fee. Guesthouses & apartments
  • More than 14 days prior to arrival: refund of deposit amount paid.
  • Less than 14 days prior to arrival, including no-shows: 100% cancellation fee.

2.2 If the required balance payment is not received by the stated due date (30 days before arrival for villas,    14   days before arrival for guesthouses/apartments,   or as otherwise specified), management reserves the right to cancel the booking.  Any deposit paid will be treated as a cancellation fee and the dates may be released and re-sold.

2.3 In the event of premature departure, guests remain  liable  for the full duration  of their  original booking.  Refunds are at the sole discretion of management  and subject  to the ability to rebook  the accommodation.

 

  1. Check-In & Guest Identification

3.1 Check-in is from 15:00 on the scheduled day of arrival, unless otherwise agreed in writing.

3.2 Early check-in may be requested and will  be accommodated where possible;  however, it cannot be guaranteed  and may incur  an additional fee.

3.3 All  guests must present  a valid  government-issued photo ID at check-in, and the main  booker must provide a valid  credit  card. These  are required as a condition of admission. The  card on file may be charged for incidental amounts as detailed in Section  17.

3.4 Personal  identification documents may be recorded for legal compliance. All  data is handled  in accordance  with  Section  5 (Privacy) and applicable law.

 

  1. Check-Out & Departure

4.1 Check-out time is by 10:00 for villas  and 11:00 for all other properties on the day of departure unless otherwise arranged.

4.2  Late  check-out  may  be  available upon  request,  subject  to  availability and  additional fees. Unauthorised late departures may incur  charges equivalent to an additional night’s stay.

4.3 Guests  are  responsible for  vacating  the  property and  returning keys/access   devices by  the check-out time.

 

  1. Privacy Policy (POPIA)

5.1  We   collect   personal   information  necessary  to  process   your   booking,   comply   with   legal obligations,  provide customer service, and improve our services. This  may  include identification, contact details, payment  information, and special requests.

5.2 Personal  information will  not be sold to third  parties.  It may  be shared  with  trusted  service providers such as payment  processors, booking  platforms,  and legal authorities when  required by law.

5.3  All   personal   data  is   processed    in   compliance  with   POPIA.   Appropriate  technical  and organisational safeguards are implemented.

5.4 We  retain  personal  data only  as long as necessary to fulfill the purposes  above  and to comply with  legal requirements, after which it is securely deleted or anonymised.

5.5 Guests may request  correction or deletion  of personal  data, or object to certain  processing,  by contacting management.

5.6 Services are  not  intended for  children under  18 without appropriate adult  supervision and consent.

 

  1. Maximum Occupancy

6.1 Each property has a maximum occupancy as specified in the listing/booking confirmation.

6.2 At no time may the number of guests exceed  this limit.

6.3 Exceeding maximum occupancy is grounds  for  immediate termination of your  stay  without refund  and may result in additional charges.

 

  1. Visitor Policy & Overnight Guest Definition

7.1 Only registered guests are permitted on the property.

7.2 Any  visitors must be announced in advance  (regardless of duration) and are not permitted to stay overnight unless officially booked and all applicable fees paid.

7.3 For avoidance of doubt, an “overnight guest” is any person  who stays on the property between

00:00 and 06:00. Any  person still present  after 06:00 will  be deemed an overnight guest.

7.4 Should  overnight guests cause  the room/property  to exceed  the stated  maximum occupancy, this constitutes a material  breach.  Management may (a) charge a full  room  fee for the additional guest(s) and/or (b) terminate the stay without refund.

 

  1. Noise & Party Policy

8.1 Parties,  events,  gatherings,  or similar group  activities are strictly prohibited unless  arranged and confirmed in writing by management.

8.2 Please keep noise to a minimum at all times, especially between 22:00 and 08:00 (quiet hours).

8.3 Failure to comply  may result in termination without refund  and additional charges.

 

  1. Noise Monitoring Devices

9.1 Certain  properties may use privacy-safe environmental sensors  (for example  Minut  devices) in selected common  areas. These sensors do not record  audio or video.

9.2 Devices measure  noise  levels  and  related  environmental data solely  to enforce  house  rules, protect neighbours, and safeguard the property.

9.3 By  confirming your  booking  and checking in,  you  consent  to the  use of such  devices during your stay.

 

  1. Smoking Policy

10.1 Riva  One is strictly non-smoking in all indoor  areas and outdoor  spaces (balconies, terraces, pool decks, gardens), unless explicitly approved in writing for a designated outdoor space.

10.2 Breach will  result in deep-cleaning fees and may lead to termination.

 

  1. Pet Policy

11.1 Pets are not allowed unless prior written approval  has been obtained from management.

 

  1. Pool & Jacuzzi Use

12.1 Use  of  any  pool  or  jacuzzi is  at your  own  risk.  No  diving  is  permitted. Children  must  be supervised at all times.

12.2 Please do not remove or tamper with  equipment. Management will  assist if needed.

12.3 Jacuzzi operating  hours:  12:00 to 21:00. Heating  is switched off overnight. Reheating  begins from 10:00 the next day and requires reasonable  time to reach temperature.

12.4 Jacuzzi temperature range is between 30°C and 35°C and may fluctuate  based on weather and usage.

 

  1. Security & Personal Belongings

13.1 Please ensure  all doors and windows are locked when  leaving  the property.

13.2 Electronic safes may be provided; use is at the Guest’s own risk.

13.3 Alfa  One Estates/Riva One is not liable  for loss, theft, or damage to personal  belongings  except in cases of proven negligence  or where liability cannot legally be excluded.

13.4 Guests should arrange adequate personal  travel,  property, and medical  insurance.

13.5 Luggage storage (if offered)  remains at the Guest’s risk, except where liability cannot legally be excluded.

 

  1. Lost Keys & Access Cards

14.1 Lost  keys,  access cards,  tags, or similar equipment will  incur  a replacement/reprogramming fee charged to the Guest.

 

  1. Security Deposit

15.1 A  security deposit  may  be required at management  discretion via  credit  card  hold  or cash deposit. Check-in may be arranged only once the deposit is received.

15.2  Refunds are  subject  to  post-check-out inspection.  Deductions  may  be  made  for  damages, missing items, or rule breaches.

15.3 Where supported,  invoices/receipts/inspection reports  will  be provided upon request.  Balance refunds are processed  within 7 to 14 days.

 

  1. Property Damage & Guest Liability

16.1 Guests  are responsible for any  damage to the property, furnishings, equipment, or common areas during their stay.

16.2 Where damages exceed  the deposit (or no deposit was collected), the Guest is liable for the full cost.

16.3 Costs may be deducted  from the deposit, charged to the credit  card on file, billed  via payment link,  or collected  via the booking platform.

 

  1. Incidental Charges & Credit Card Authorisation

17.1 All  guests must provide a valid  credit  card at check-in (via  online  pre-check-in form  or upon arrival). The  card  may  be  pre-authorised in  an  amount  determined by  management   to  cover potential  incidentals and/or the security deposit.

17.2 By  supplying card details,  you  authorise Alfa  One Estates/Riva One to charge for incidentals including, without limitation:

  • Minibar consumption not included or any charges resulting from unreasonable/excessive minibar consumption (see Section  18).
  • Spa treatments, laundry, and other services booked through management  and not paid directly.
  • Restaurant bookings, activities, guides, deposits, and third-party services arranged at the Guest’s request  (see Section  19).
  • Damage or removal of property and contents.
  • Deep-cleaning fees (for example  smoking).
  • Late check-out fees.
  • Lost key/access card fees.

17.3 You authorise  management  to charge the card for any such fees identified during your stay or after departure.

 

  1. In-Room Minibar (Inclusive Use)

18.1 The in-room  minibar is inclusive unless otherwise stated in your booking confirmation.

18.2 Minibar items and brands may vary  and depend on availability and seasonality.

18.3 The  minibar is  intended for  reasonable   personal  consumption. Unreasonable or  excessive consumption  (as  determined  at  management’s discretion),  stockpiling,  redistribution  to  non- registered guests, or removal of minibar items from  the property may result  in additional charges and/or suspension of replenishment.

 

  1. Additional Services & Third-Party Charges

19.1 At the Guest’s request,  management  may arrange additional services (for example: helicopter flights,  private guides, transfers, tours, wellness services). Unless  expressly stated otherwise, such services are not included in the accommodation rate.

19.2 Charges for such services may be added to the Guest account and settled at the end of the stay, or charged to the credit card on file.

19.3 Alfa  One Estates/Riva One acts solely  as an intermediary for third-party providers and is not liable  for their  acts, omissions, delays,  cancellations, or performance except  where liability cannot legally be excluded.

 

  1. Prohibited Activities

20.1 Cryptocurrency mining  or any activity involving excessive or abnormal  electricity usage (for example  high-powered servers or industrial-scale computing  equipment) is strictly prohibited.

20.2  Where  identified, the  Guest  is  liable   for  electricity  consumed and  any  related   damages, penalties,  or costs.

 

  1. Commercial Use, Photography & Filming

21.1 Any  professional or commercial use of the property (including photography,  filming,  content creation,   social  media   shoots,  interviews,  recordings) is  not  permitted  without  prior   written consent from management.

21.2 Unauthorised commercial activity may be stopped  immediately and may result  in additional fees or termination.

21.3 Drone  operation  is not permitted without prior  written consent  and is governed by the Drone

Policy  in Annexure C.

 

  1. Influencer, Press & Hosted Stays

22.1 Any  hosted,  influencer, press,  barter,  or discounted stay  remains subject  to these  Terms  & Conditions unless expressly varied  in writing in a separate agreement.

22.2  Influencers/hosted  guests  may   not  use  the  property  for   any   additional  commercial  or promotional use unless  prior  specified in writing. If unauthorised commercial use occurs, management   may  apply  commercial usage  fees,  additional charges,  terminate the  stay,  and/or pursue  legal remedies.

  1. Illegal Activities

23.1 Illegal  behaviour is strictly forbidden and will  result  in immediate termination of your  stay and possible  legal action.

 

  1. Rule Violations & Disciplinary Actions

24.1 Non-compliance with  these  rules  may  result  in a written warning and timeframe to remedy the breach.

24.2 Failure to remedy, repeated  violations, or conduct  threatening the  property, staff,  or other guests may result  in termination, forfeiture of payments, and legal procedures to require guests to vacate.

24.3 Management will  document communications and actions. Except in cases of criminal activity, serious  endangerment, or illegal acts, guests will  be given reasonable  opportunity to respond.

24.4 If guests are required to vacate after due process, no refunds will  be issued and guests remain liable for additional charges, damages, or costs.

 

  1. Children & Child Safety

25.1 Children are welcome where permitted, but must be supervised at all times, especially around pools, balconies,  stairs, and glass elements.

25.2  Properties  are   not   child-proofed.  The   child’s   legal   guardian/supervising  adult/booking signatory  accepts full responsibility for the child at all times, including any incident, injury, loss, or damage caused by or involving the child.

25.3 Guests  may  be  required to sign  a child  safety  indemnity acknowledging responsibility for supervision and safety.

 

  1. Hazardous Goods

26.1 Storing or bringing hazardous,  combustible, or objectionable items onto the property is strictly prohibited.

 

  1. Water Restrictions

27.1  Guests   must   comply   with   all   local   water   restrictions  and   regulations  as  imposed   by authorities.

27.2 Restricted water usage is not grounds for cancellation or refund.

 

  1. Management Rights

28.1 Management reserves the right to require a guest to vacate  the property for breach  of these

Terms,  in accordance  with  South African law, including the PIE Act, where applicable.

 

28.2 In cases of immediate threat,  criminal activity, or illegal  conduct,  management  may  require guests to vacate without prior warning, subject to applicable law.

 

  1. Force Majeure

29.1 Neither party  shall be liable  for delay  or failure to perform obligations  due to events  beyond reasonable  control,  including natural  disasters,  fire, floods, pandemics, war, terrorism, civil unrest, government regulation, strikes,  or utility failures.

29.2 In force majeure  events,  management  may offer rescheduling or credit  at its discretion, taking into account circumstances and applicable law.

29.3  Where  possible,   management   will   assist   in  sourcing   alternative  accommodation if  the property becomes unavailable. Remedies may be limited to amounts received.

 

  1. Limitation of Liability

30.1 To the fullest extent permitted by law,  Alfa  One Estates/Riva One liability is limited to direct losses arising from proven negligence in providing  accommodation/management services. No liability is accepted for indirect or consequential loss, including loss of enjoyment or loss of holiday value.

30.2  Claims  relating  to  building   services or  third-party  contractors lie  primarily against  those responsible parties, except where liability cannot legally be limited.

 

  1. Governing Law & Jurisdiction

31.1 These Terms  & Conditions are governed by the laws of the Republic of South Africa.

31.2 Any  dispute  may be brought  in a court of competent jurisdiction in Cape Town, South Africa, without limiting any non-excludable consumer rights.

 

  1. Amendments

32.1 Management reserves the right to amend  these Terms  & Conditions at any time.  The  version applicable to your  stay is the version provided with  your  booking  confirmation or made available prior to check-in.

 

Acknowledgement

By  booking  and  checking in,  you  confirm that  you  have  read,  understood, and  agreed  to these Terms  & Conditions, including the annexures below.

ANNEXURE A

Riva One Parking & Access Gate Terms & Conditions Addendum

This  Addendum forms  part  of the  accommodation agreement  between the  Guest  and Riva  One, operated  by  Alfa  One  Estates  (Pty)  Ltd  (the  “Property”). By  signing  below  and/or  by  using  the parking  facilities and access gate systems,  the Guest agrees to the following terms.

  1. Parking at Own Risk:  On-site  parking  is provided entirely at the Guest’s own  risk.  The  Property shall  not  be  liable  for  loss  of  or  damage  to vehicles or  contents.  Parking  is  permitted only  in designated areas.
  2. Gate Access & Access Devices: Access  devices are issued  for personal  use only  and may  not be shared. The Guest must ensure  the gate is fully  closed after every entry  and exit.
  3. Proper Use & Responsibility: Leaving the gate open, tailgating, or tampering with  access systems constitutes negligence.  Any  resulting loss or incident is the Guest’s responsibility.
  4. Liability & Indemnity: The Guest indemnifies and holds harmless the Property against all claims arising from misuse, negligence, or failure to secure the gate.
  5. Loss or Damage to Access Devices: Lost or damaged devices may incur replacement or reprogramming fees.
  6. Security Systems & Limitations: Security measures   are  deterrents only  and  not  guarantees. Cameras are not actively monitored.
  7. Vehicle Movement: All vehicle movement within the property is undertaken at the Guest’s own risk.
  8. Breach & Restriction: Gate access may be withdrawn in cases of misuse or non-compliance.
  9. Acknowledgement: By signing below, the Guest confirms understanding and acceptance  of this Addendum.

ANNEXURE B

Riva One – E-Bike Use, Assumption of Risk & Indemnity Agreement

Legal Entity: Riva  One  is a hospitality brand  operated  by  Alfa  One  Estates  (Pty)  Ltd,  a company registered in  the Republic of South  Africa. All  references to “Riva  One”  include Alfa  One Estates (Pty)  Ltd, its directors, employees, agents, and contractors.

  1. Age & Legal  Capacity:  The  Guest  confirms that  they  are  at least  18 years  of  age and  legally competent to enter into this agreement.
  2. Voluntary Use & Assumption of Risk: The Guest  acknowledges that the use of e-bikes  involves inherent risks  including traffic  accidents,  uneven terrain,  weather conditions, mechanical failure, injury, illness,  permanent disability, or death.  Participation is voluntary and at the  Guest’s  own risk.
  3. Medical Fitness: The Guest  confirms that they  are physically and medically fit to operate  an e- bike and that Riva One does not provide medical  advice,  assessment,  or supervision.
  4. No Instruction  or  Supervision:  The   Guest   acknowledges  that  Riva   One  does  not  provide professional instruction, supervision, or guidance unless explicitly agreed in writing.
  5. Release, Waiver & Indemnity: To the fullest extent  permitted under  South African law, the Guest waives and releases  Alfa One Estates (Pty)  Ltd and Riva  One from all claims arising from use of the e-bike  equipment, excluding gross negligence  or wilful misconduct where not legally  excludable. The  Guest  indemnifies and  holds  harmless  Alfa  One  Estates  (Pty)  Ltd  and  Riva  One  against  all claims, losses, damages, and legal costs arising from their use of the equipment.
  6. Third-Party Liability: The Guest accepts  full  personal  liability for  any  injury, loss,  or damage caused  to  third  parties,  including  pedestrians, motorists,   cyclists, or  property, while  using  the equipment.
  7. Damage, Loss & Theft: All  equipment remains the property of Alfa  One  Estates  (Pty)  Ltd.  The Guest is fully  liable  for any loss, theft,  or damage to the equipment or accessories and authorises the  charging  of  repair  or  replacement  costs  to  the  credit  card  on  file.  Normal  wear  and  tear excepted.
  8. Weather & Road Conditions: The Guest accepts  that weather, traffic,  and road conditions may change at any time and assumes all risks associated with  riding under such conditions.
  9. Rules of Use:  E-bikes are  available on  a first-come, first-served  basis.  Use  is  permitted only between 08:00 and 17:00. Bikes  must be returned no later than 17:00. Helmets must be worn  at all times. South African road traffic laws must be complied with.  Riding  under  the influence of alcohol or drugs is strictly prohibited.
  10. Right to Refuse or Revoke Access: Riva  One reserves the right to refuse  or revoke e-bike  access at its sole discretion for safety, weather, operational, or behavioural reasons.
  11. Governing Law: This agreement  is governed by the laws  of the Republic of South  Africa and subject to the jurisdiction of South African courts.
  12. Acknowledgement: By signing below, the Guest confirms that they have read, understood, and voluntarily accept all terms of this Agreement.

ANNEXURE C

Drone Policy for Riva One

At Riva  One, we are committed to ensuring the safety, privacy, and enjoyment of all our guests. To maintain these standards,  the following drone policy has been established and must be adhered to strictly.

  1. Drone Operation Approval: All drone operations on Riva One property require prior written information to management in a timely manner so that management can inform other guests where necessary.
  2. Privacy and Safety Restrictions: Drones must not capture footage or images within 50 meters of any guest accommodation or private areas, including rooms, balconies,  and private spaces.
  3. Privacy and Safety Restrictions: Drones may not operate in close proximity to any guest or staff without their explicit consent.
  4. Privacy and Safety Restrictions: Flight paths must comply with local aviation safety regulations and avoid causing any disturbance.
  5. Privacy and Safety Restrictions: If a guest or staff member objects to being included in footage, the operator must delete all relevant footage, including any backups, immediately upon request.
  6. Prohibited Uses: Drones must not be flown indoors.
  7. Prohibited Uses: Drones are prohibited in areas deemed unsafe or restricted by management.
  8. Commercial Use and Promotional Content:  Any material captured on Riva  One property that combines Riva  One’s brand with third-party entities for commercial or promotional use requires prior written approval.  Unauthorised use of such material may result in legal action.
  9. General Compliance: Drone operators must comply with all applicable laws and regulations governing drone use, including weight, distance, and no-fly zone requirements.
  10. General Compliance: Operators are solely responsible for ensuring the safe operation of their drones.
  11. Acknowledgement: By operating a drone on Riva  One property, you acknowledge and agree to abide by this policy.  Non-compliance may result in confiscation of the drone,  removal from the property, and/or legal action.
